1. Acceptance of Terms
By accessing or using SoftMaxx (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and the operator of SoftMaxx ([TODO: legal entity name], "SoftMaxx," "we," "us," or "our"). Your continued use of the Service after any changes to these Terms constitutes acceptance of the updated Terms.
2. Service Description
SoftMaxx is an AI-powered face analysis web application designed for self-improvement and informational purposes. The Service analyzes facial geometry from photos you submit and generates scores, measurements, and recommendations ("Analysis Results") using a combination of open-source computer vision tools and OpenAI's vision API.
SoftMaxx is intended solely as a personal self-improvement tool. Analysis Results are generated algorithmically and are subject to error. The Service is not a medical service, diagnostic tool, or substitute for professional advice of any kind. See Section 8 (Disclaimer of Warranties) and Section 10 (AI-Generated Content Disclaimer) for important limitations.
3. Eligibility
You must be at least 18 years of age to use SoftMaxx. By using the Service, you represent and warrant that you are 18 or older. We do not knowingly provide services to individuals under 18. If we learn that a user is under 18, we will terminate their account and delete associated data.
You also represent that you have the legal capacity to enter into these Terms in your jurisdiction.
4. Account & Subscriptions
4.1 Free Tier
SoftMaxx offers a free tier with limited functionality, including a restricted number of face analyses per period. Free tier features may change at our discretion with reasonable notice.
4.2 Paid Subscriptions
SoftMaxx offers two paid subscription tiers, billed through Stripe:

4.3 Auto-Renewal
All paid subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. By subscribing, you authorize SoftMaxx to charge your payment method on file for each renewal period.
4.4 Cancellation

Cancellation takes effect at the end of the current billing period — you retain access to paid features through the end of the period you have paid for. We do not offer pro-rated refunds for partial billing periods except as provided in the Refund Policy (Section 5).
4.5 Account Responsibility
You are responsible for maintaining the confidentiality of any credentials associated with your account and for all activity that occurs under your account. One account per person — creating multiple accounts to circumvent free tier limits or access multiple trials is prohibited.
5. Refund Policy
30-Day Money-Back Guarantee
SoftMaxx offers a 30-day money-back guarantee on your first subscription purchase. If you are not satisfied with your Pro or Elite subscription, you may request a full refund of your initial charge within 30 days of that charge.
How to Request a Refund
Email support@softmaxx.io within 30 days of your initial subscription charge with the subject line "Refund Request." Include the email address associated with your account. We will process eligible refunds within 5–10 business days.
Scope of the Guarantee
- The 30-day guarantee applies only to the first charge of a new subscription (initial purchase).
- Subsequent renewal charges are not eligible for refund.
- If you cancel and resubscribe, the new subscription is treated as a first purchase for guarantee purposes only if at least [TODO: define cooling-off period, e.g., 6 months] has elapsed since any prior refund.
- Pro-rated refunds for partial billing months are not offered.

6. Acceptable Use
By using SoftMaxx, you agree to the following rules:
- One account per person. Creating multiple accounts to circumvent limits is prohibited.
- No scraping or automated access. You may not scrape, crawl, or use automated tools to access the Service, its APIs, or any Analysis Results at scale.
- No reverse engineering. You may not attempt to decompile, disassemble, or reverse engineer any part of the Service, including the scoring algorithm or AI prompts.
- No API abuse. Do not submit excessive requests that place unreasonable load on the Service's infrastructure.
- Photos of yourself only. Only upload photos of yourself, or photos for which you have obtained explicit consent from the person depicted. Do not upload photos of others without their knowledge and consent.
- Adults only in photos. Only upload photos depicting an adult face (18 years of age or older). Submitting photos of minors is strictly prohibited and may be reported to relevant authorities.
- No harmful use. Do not use Analysis Results to harass, demean, or harm any individual.
- Compliance with law. You must comply with all applicable laws in your jurisdiction when using SoftMaxx.
Violation of these rules may result in immediate termination of your account without refund.
7. Intellectual Property
SoftMaxx IP: The Service, including the analysis methodology, scoring algorithm, software, design, and all content produced by SoftMaxx (excluding your Analysis Results and your photos), is owned by SoftMaxx and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any SoftMaxx content without express written permission.
Your photos: You retain all rights to the photos you upload. By submitting a photo, you grant SoftMaxx a limited, non-exclusive, royalty-free license to process your photo solely for the purpose of generating your Analysis Results. We do not store your photos after analysis completes and we do not use your photos for any other purpose, including training AI models.
Your Analysis Results: Analysis Results generated from your photo are provided to you for your personal use. You may share your own results at your discretion. You may not commercially exploit or distribute Analysis Results generated from other people's photos without their consent.
8. Disclaimer of Warranties
As-Is Service
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

SoftMaxx is for informational and self-improvement purposes only. Analysis Results, scores, and recommendations are algorithmic outputs — they are not medical diagnoses, dermatological assessments, psychological evaluations, or any other form of professional advice.
SoftMaxx is NOT a substitute for advice from a licensed physician, dermatologist, surgeon, psychologist, or any other licensed professional. Do not make medical, surgical, cosmetic, or other health decisions based solely on SoftMaxx Analysis Results.
Algorithmic Limitations
Facial scoring is inherently subjective and subject to algorithmic error. Results may vary based on photo quality, lighting, angle, and other factors. SoftMaxx makes no representation that its scores are accurate, complete, or free from error.
No Uptime Guarantee
We do not warrant that the Service will be uninterrupted, error-free, or available at any particular time. We may modify, suspend, or discontinue the Service at any time with or without notice.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOFTMAXX AND ITS OPERATORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL SOFTMAXX'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL FEES YOU PAID TO SOFTMAXX IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the above limitations shall apply to the fullest extent permitted by law.
10. AI-Generated Content Disclaimer
Analysis Results and recommendations generated by SoftMaxx are produced in part by OpenAI's GPT-4o large language model via OpenAI's API. AI-generated content has inherent limitations:
- Recommendations are not reviewed by licensed medical, dermatological, cosmetic, or other professionals.
- AI models can produce inaccurate, incomplete, or contextually inappropriate output.
- Recommendations about skincare products, supplements, cosmetic procedures, or any other treatments should be treated as general informational suggestions only.
- You should consult a licensed professional — dermatologist, physician, cosmetic surgeon, or relevant specialist — before making any treatment, procedure, supplement, or lifestyle decisions based on SoftMaxx recommendations.
- SoftMaxx is not affiliated with OpenAI and does not control the outputs of OpenAI's models beyond the prompts we submit.
OpenAI's terms of service and usage policies apply to the processing of your data through OpenAI's API. OpenAI's privacy policy is available at openai.com/policies/privacy-policy.
11. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will:
