Terms of Service

1. Acceptance of Terms

By accessing or using SoftMaxx (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and the operator of SoftMaxx (SOFTMAXX, a business registered in Ontario, Canada (BIN 1001665584), "SoftMaxx," "we," "us," or "our"). Your continued use of the Service after any changes to these Terms constitutes acceptance of the updated Terms.

2. Service Description

SoftMaxx is an AI-powered face analysis web application designed for self-improvement and informational purposes. The Service analyzes facial geometry from photos you submit and generates scores, measurements, and recommendations ("Analysis Results") using a combination of open-source computer vision tools and OpenAI's vision API.

SoftMaxx is intended solely as a personal self-improvement tool. Analysis Results are generated algorithmically and are subject to error. The Service is not a medical service, diagnostic tool, or substitute for professional advice of any kind. See Section 8 (Disclaimer of Warranties) and Section 10 (AI-Generated Content Disclaimer) for important limitations.

3. Eligibility

You must be at least 18 years of age to use SoftMaxx. By using the Service, you represent and warrant that you are 18 or older. We do not knowingly provide services to individuals under 18. If we learn that a user is under 18, we will terminate their account and delete associated data.

You also represent that you have the legal capacity to enter into these Terms in your jurisdiction.

4. Account & Subscriptions

4.1 Free Tier

SoftMaxx offers a free tier with limited functionality, including a restricted number of face analyses per period. Free tier features may change at our discretion with reasonable notice.

4.2 Paid Subscriptions

SoftMaxx offers two paid subscription tiers, billed through Stripe:

Subscription prices are in US dollars and are subject to applicable taxes where required by law.

4.3 Auto-Renewal

All paid subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. By subscribing, you authorize SoftMaxx to charge your payment method on file for each renewal period.

4.4 Cancellation

You may cancel your subscription at any time from your account page at softmaxx.io/account, or by emailing support@softmaxx.io. Cancellation takes effect at the end of the current billing period — you retain access to paid features through the end of the period you have paid for. We do not offer pro-rated refunds for partial billing periods except as provided in the Refund Policy (Section 5).

4.5 Account Responsibility

You are responsible for maintaining the confidentiality of any credentials associated with your account and for all activity that occurs under your account. One account per person — creating multiple accounts to circumvent free tier limits or access multiple trials is prohibited.

Free trial. There is one free trial per person, per payment card and per device: a trial started with a card, email address or device that has already had one is cancelled straight away, with no charge, and you can subscribe instead. Prepaid cards cannot start a free trial. If you cancel during your free trial, the trial ends immediately, paid features stop at once, and you are not charged. If a payment fails, paid features stop until the payment goes through.

4.6 Bonus Scans

SoftMaxx AI may give you bonus scans on top of your plan: one when a friend completes their first scan through your share link, and one for giving your email address on the scan-limit screen. Bonus scans:

• have no cash value and cannot be exchanged for money;
• are limited to 3 referral bonus scans per calendar month (counted in UTC) and one email bonus scan per person;
• are used after the scans your plan already includes for the month;
• may be withheld or removed when we detect abuse, such as referring yourself (including from your own device or network), creating extra identities, or using disposable email addresses.

By using SoftMaxx, you agree to the following rules:

• One account per person. Creating multiple accounts to circumvent limits is prohibited.
• No scraping or automated access. You may not scrape, crawl, or use automated tools to access the Service, its APIs, or any Analysis Results at scale.
• No reverse engineering. You may not attempt to decompile, disassemble, or reverse engineer any part of the Service, including the scoring algorithm or AI prompts.
• No API abuse. Do not submit excessive requests that place unreasonable load on the Service's infrastructure.
• Photos of yourself only. Only upload photos of yourself, or photos for which you have obtained explicit consent from the person depicted. Do not upload photos of others without their knowledge and consent.
• Adults only in photos. Only upload photos depicting an adult face (18 years of age or older). Submitting photos of minors is strictly prohibited and may be reported to relevant authorities.
• No harmful use. Do not use Analysis Results to harass, demean, or harm any individual.
• Compliance with law. You must comply with all applicable laws in your jurisdiction when using SoftMaxx.

Violation of these rules may result in immediate termination of your account without refund.

7. Intellectual Property

SoftMaxx IP: The Service, including the analysis methodology, scoring algorithm, software, design, and all content produced by SoftMaxx (excluding your Analysis Results and your photos), is owned by SoftMaxx and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any SoftMaxx content without express written permission.

Your photos: You retain all rights to the photos you upload. By submitting a photo, you grant SoftMaxx a limited, non-exclusive, royalty-free license to process your photo solely for the purpose of generating your Analysis Results. We do not store your photos after analysis completes and we do not use your photos for any other purpose, including training AI models.

Your Analysis Results: Analysis Results generated from your photo are provided to you for your personal use. You may share your own results at your discretion. You may not commercially exploit or distribute Analysis Results generated from other people's photos without their consent.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOFTMAXX AND ITS OPERATORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL SOFTMAXX'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL FEES YOU PAID TO SOFTMAXX IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the above limitations shall apply to the fullest extent permitted by law.

10. AI-Generated Content Disclaimer

Analysis Results and recommendations generated by SoftMaxx are produced in part by OpenAI's GPT-4o large language model via OpenAI's API. AI-generated content has inherent limitations:

• Recommendations are not reviewed by licensed medical, dermatological, cosmetic, or other professionals.
• AI models can produce inaccurate, incomplete, or contextually inappropriate output.
• Recommendations about skincare products, supplements, cosmetic procedures, or any other treatments should be treated as general informational suggestions only.
• You should consult a licensed professional — dermatologist, physician, cosmetic surgeon, or relevant specialist — before making any treatment, procedure, supplement, or lifestyle decisions based on SoftMaxx recommendations.
• SoftMaxx is not affiliated with OpenAI and does not control the outputs of OpenAI's models beyond the prompts we submit.

OpenAI's terms of service and usage policies apply to the processing of your data through OpenAI's API. OpenAI's privacy policy is available at openai.com/policies/privacy-policy.

11. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

• Update the "Last updated" date at the top of this document.
• Send an email notification to the address on file, where practical.
• Post a notice on the Service.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may request a cancellation of your subscription.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada.

If you are a consumer in a jurisdiction that does not permit exclusive jurisdiction clauses, this section shall apply to the fullest extent permitted by applicable law.

12A. Peptide information, calculators and tracker

12A.1 Information only. Peptide pages summarize published research and regulatory status. They are not medical advice, a recommendation to use any substance, or an offer to sell. Many substances discussed are not approved for human use in the United States or Canada. You are responsible for complying with the laws where you live.

12A.2 Calculators do math on your numbers. Calculators convert values you enter (such as the amount in a vial and the volume of liquid added) into other units. They do not know whether any value is correct, safe or appropriate for you. They do not recommend a substance, dose, schedule or route. They are not medical devices. Double-check every result with your pharmacist or prescriber before use. Incorrect inputs produce incorrect results.

12A.3 Tracker records what you enter. The tracker stores and reminds you of the entries and schedule you create. It does not verify what you take, check for interactions, or alert anyone if something goes wrong. It is not an emergency service: if you have a severe reaction, call 911 (US/Canada) or your local emergency number.

12A.4 No sellers. SoftMaxx does not sell, source, test or endorse any peptide or supplier, and accepts no payment from them. Links to suppliers are not permitted in user content.

12A.5 Adults only. Peptide features are available only to users 18 or older who confirm their age.

12A.6 Your responsibility. You agree not to use SoftMaxx to obtain, sell, or promote any substance, and not to rely on SoftMaxx for any decision about your health. The limitation of liability section applies to these features.
